that upheld the individual mandate provision of president obama's health care reform legislation, and i'm wondering, for those of us who are observers of the court, apart from the holding in the case, what lessons might we learn from the experience of that case? >> i hope it's a case that will be taught in law schools. i fully expect that my defense saying that this legislation fit within the commerce clause easily, that that will someday become the law of the land. i was astonished, frankly, at the majority view about that case. but i think it's a wonderful teaching tool. and as you know, the law and the meaning was a failed. achieve -- was upheld. the chief justice decided it didn't fit within the commerce power but the tax power is very broad, so what the law calls a penalty was, in fact, a tax and so it was upheld on that basis. so i do think the commerce clause ruling will turn out to be an aberration. and you can compare it to the way it was before 1937. when the court, now referred to as nine old men, and they were striking down economic and social legislation from the states, fr

. and this afternoon we are honored to host hillary rodham clinton. during her last 24 hours as president obama's first president obama's first secretary of state and immediately afterwards and told she might be expected to party like it's cartagena all over again. [laughter] we did a research and this is the eighth time that hillary clinton has spoken at the council and her third appearance in and her current incarnation as secretary of state. this afternoon speech is probably the most anticipated one she has given here and indeed it may be the most anticipated farewell address since 1796. [laughter] i suspect though that her views on untangling alliances might be somewhat different than george washington's. much has been made of the mile she has put in as the country's 67 secretary of state. you've seen the using the statistics. she has visited 112 countries and locked -- miles of flight time. more important than that madam secretary is what you have put into these miles and your 10 years coincide with what the most consequential events and decisions of this young century the balancing american for

of the obama presidency begins. at least the part the president would like to accomplish and where he sees the nation headed. he faces, of course, a sharply divided congress, sometimes violently so, and a divided viewing audience. here tonight, a nation starting to see some daylight after years of recession, and it's the long, suffering middle class that will be the target of much of his message tonight. we should tell you at the same time, we are following a very tense news event, across the continent on the west coast in the san berardino mountains, gunfire and then a fire over an hour we've been watching this in a cabin in the woods believed to contain the sniper, ex-cop, the military veteran that has terrorized southern california for days. another loss of life tonight. a police deputy there confirmed dead and if this situation is resolved, we're keeping a close eye on it, we will let you know, following the conclusion of the president's remarks. back inside the house chamber we go, we've been watching arrivals tonight. first lady has taken her seat. members of the supreme court. and n

the beginning you mentioned listening to the silent majority, so president obama and secretary clinton have both rebalance their focus to asia-pacific, and you have worked with burma. my question is for southeast asia, will you share your vision for how to build capacity for burma and how to build burma up. also, how to work into that the code of conduct and the rule of law in the southeast asia see. would that help to resolve conflicts we are concerned about? >> i think it would for sure. since i have not had a chance to visit burma myself yet, i am probably less conversant with it than the other major cases we are working on a month but clearly there is plenty of opportunity for progress in this space and u s policy really trying to drive that. in terms of the rest of southeast asia, the way we look at future engagements, i think there probably are a couple of countries we have to be sensitive to, and that we are reviewing, but we have not gotten much beyond that stage. so, sorry not to be better informed to answer your question. >> way in the back row there. >> thank you, claudia. will davis.

on the topic of gun violence. chuck todd, you have covered the obama administration as chief white house correspondent. how would you sum this up? >> to me, a couplef speeches. a very run of the mill state of the union, where he was putting together agenda item after agenda item. sounded like the campaign and sounded like it was very well focused, minimum wage, pre-k, things people care about at home, education and jobs. and then the entire tone of the speech changed at the end. incredibly emotional. you don't find many state of the unions that have moments like that. we've had -- he's had to do a state of the union right after the gabby giffords shooting that had some emotional moments and that was something else. and, boy, did he pull his full weight behind guns in a way that i don't think a lot of people expected. think about the fact of what he pushed. they deserve a vote. realize, that's all. they deserve a vote. almost an acknowledgment and an emotional push, that's all they are going to get, if they are lucky. >> savannah guthrie, you and i for one were out in tucson together. the
